Welcome to Peak Season ("The Event"). By purchasing a ticket, registering for a competition, or attending the event in any capacity, you ("The Attendee" or "The Participant") agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree with any part of these terms, you must not register for or attend the event.
1. Registration and Participation
1.1. Eligibility: Participation in competitive events is open to individuals who meet the specific age and skill requirements for each category. "Junior" categories are restricted to participants under the age of 18. "Pro" categories require proof of prior competitive experience or professional licensure.
1.2. Ticket Validity: All tickets and registrations are personal, revocable licenses. They are valid only for the specific dates and times indicated. Unauthorized resale or transfer of tickets is strictly prohibited and may result in the cancellation of the ticket without refund.
1.3. Identification: Participants must present valid government-issued photo identification upon check-in to receive their event credentials, lift passes, and timing chips.
2. Assumption of Risk and Liability Waiver
2.1. Inherent Risks: Alpine skiing, snowboarding, and attending mountain festivals involve inherent risks, dangers, and hazards. These include, but are not limited to: changing weather conditions, steep terrain, ice, natural and man-made obstacles, equipment failure, collisions with other participants or objects, and the negligence of others.
2.2. Release of Liability: By attending Peak Season, you voluntarily assume all risks associated with the event. You hereby release, waive, discharge, and covenant not to sue Peak Season Organizers, the host resort, sponsors, volunteers, and agents from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you.
2.3. Personal Property: The organizers are not responsible for lost, stolen, or damaged personal property, including ski equipment, electronics, or vehicles parked at the venue.
3. Cancellation and Refund Policy
3.1. Event Cancellation by Organizers: Peak Season reserves the right to cancel, postpone, or modify the event due to extreme weather conditions, safety concerns, force majeure (including pandemics, government restrictions, or natural disasters), or other causes beyond our reasonable control. In the event of a total cancellation, ticket holders will be offered a refund or a rollover to the following year's event, at the organizer's discretion.
3.2. Participant Cancellation: All ticket sales are final. No refunds will be issued for participants who are unable to attend due to personal injury, travel delays, or change of plans. Participants may transfer their registration to another eligible individual up to 14 days prior to the event, subject to a $25 administration fee.
4. Code of Conduct
4.1. Safety First: Reckless skiing or snowboarding that endangers others will not be tolerated. Participants must adhere to the Alpine Responsibility Code at all times. Failure to do so may result in the immediate confiscation of your lift pass and expulsion from the event without refund.
4.2. Respect: Peak Season is an inclusive community event. Harassment, discrimination, or abusive behavior towards staff, volunteers, or other attendees is strictly prohibited.
4.3. Substance Use: The consumption of alcohol is permitted only in designated licensed areas for attendees of legal drinking age. The use of illegal drugs is strictly prohibited. Competitors must not be under the influence of alcohol or drugs during competition.
5. Media Release
By entering the event premises, you consent to being photographed, filmed, and recorded. You grant Peak Season and its sponsors the perpetual, worldwide, royalty-free right to use your image, likeness, voice, and performance in any media for promotional, marketing, and broadcasting purposes without compensation.
6. Medical Consent
In the event of an injury or medical emergency, you authorize Peak Season medical staff and local emergency services to administer first aid and to arrange for transportation to a medical facility if deemed necessary. You agree to be financially responsible for any costs incurred for such medical treatment or transport.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia.
